Welcome to FonderFlicks (“FonderFlicks,” “FF,” “we,” “our,” or “us”). These Terms & Conditions govern your access to and use of the FonderFlicks website, event galleries, digital products, purchases, downloads, accounts, and related services.

By accessing or using this website, creating an account, purchasing a digital product, downloading an image, or otherwise using FonderFlicks, you agree to these Terms & Conditions.

If you do not agree to these Terms, please do not use the website or purchase products through FonderFlicks.

1. About FonderFlicks

FonderFlicks is a sports photography platform that allows customers to browse event galleries and purchase digital photographs and related digital products.

Products may include:

Individual photo downloads
Multi-photo bundles
Full-event galleries
Other digital photography products or services offered from time to time

Product availability, pricing, and included content may vary by event.

2. Eligibility to Use the Site

The website and purchasing services are intended primarily for adults, including parents, legal guardians, coaches, team representatives, and other adult customers.

Children under 13 should not independently create accounts, submit personal information, or make purchases without the involvement of a parent or legal guardian.

If you make a purchase through FonderFlicks, you represent that you are legally able to enter into the transaction or are doing so with appropriate parental or guardian authorization.

3. Digital Products

FonderFlicks primarily sells digital products.

Digital products may be delivered through Wix Stores, email, a download link, account access, or another digital delivery method.

Wix currently delivers digital-product download links after payment is received, and those links may expire after a period of time.

Customers are responsible for downloading and securely storing purchased files after delivery.

FonderFlicks may resend a digital file or download link when reasonably necessary to correct a delivery problem.

4. Pricing and Payment

Prices are shown in U.S. dollars unless otherwise stated.

Current digital photography packages may include:

Single Photo Download
5-Photo Bundle
Full Game Gallery

Prices may change at any time before purchase.

The price in effect at checkout will control.

Payments may be processed through Wix, Wix Payments, PayPal, Stripe, or another supported payment provider.

FonderFlicks does not guarantee that every listed payment method will be available to every customer.

5. Promotional Codes and Discounts

FonderFlicks may offer coupon codes, promotional discounts, player benefits, or other special pricing.

Promotional codes:

may be limited to certain customers, products, events, or time periods
may have usage limits
may not be combined with other promotions unless expressly allowed
have no cash value
may be modified, suspended, or discontinued at any time before redemption

FonderFlicks reserves the right to reject or cancel use of a promotional code that was obtained, distributed, or used improperly.

6. Refunds and Digital Purchases

Because FonderFlicks sells digital products that may be delivered immediately after payment, purchases are generally considered final once the digital product has been successfully delivered or downloaded.

Refund requests may be considered in situations such as:

Duplicate purchases
A technical failure that prevents delivery
A materially incorrect digital file being delivered
A confirmed billing error
Another situation where FonderFlicks determines that a refund is appropriate

Requests based solely on buyer preference, image selection, or failure to download a successfully delivered product may not qualify for a refund.

FonderFlicks may issue full or partial refunds at its discretion where appropriate. Wix supports full and partial order refunds through its order-management tools.

Nothing in this policy limits any consumer rights that cannot legally be waived.

7. Personal-Use License

Unless otherwise stated in writing, purchasing a photograph from FonderFlicks gives the purchaser a non-exclusive, non-transferable license for personal use.

Personal use generally includes:

Saving the image on personal devices
Printing the image for personal or family use
Sharing the image on personal social-media accounts
Using the image in personal photo books, albums, or displays

A purchase does not transfer ownership of the copyright.

8. Prohibited Uses

Unless you have prior written permission from FonderFlicks or the applicable rights holder, purchased photographs may not be:

Resold
Redistributed as standalone digital files
Licensed to third parties
Used in paid advertising
Used for commercial merchandise
Used for commercial sponsorship campaigns
Submitted to stock-photo services
Used to create products for resale
Used in a misleading, defamatory, unlawful, or harmful manner
Used in a way that falsely suggests endorsement by an athlete, team, organization, or FonderFlicks

Commercial-use licensing may be available separately upon request.

9. Copyright and Intellectual Property

Unless otherwise stated, photographs, graphics, logos, site designs, text, branding, and other original content displayed through FonderFlicks are protected by copyright and other intellectual-property rights.

Purchasing a photograph does not transfer ownership of the underlying copyright.

Wix’s guidance likewise recommends clearly retaining intellectual-property ownership in website terms and making clear that customers do not receive ownership rights merely by accessing or purchasing content.

No content from FonderFlicks may be copied, reproduced, sold, licensed, distributed, or commercially exploited except as expressly allowed by these Terms or with written permission.

10. Event and Gallery Availability

FonderFlicks does not guarantee that:

every event will be photographed
every athlete will appear in a gallery
every photograph taken will be published
every event gallery will remain available indefinitely
every image will remain available for purchase forever

Photographs may be added, removed, reorganized, corrected, restricted, or unpublished at any time.

Gallery titles, event names, player associations, dates, locations, and other descriptive information may occasionally contain errors and may be corrected without notice.

11. Images of Youth Athletes

Many FonderFlicks galleries involve youth sports.

Photographs may include minors who participated in or attended sporting events, tournaments, practices, training sessions, or related activities.

FonderFlicks may remove or restrict photographs when reasonably appropriate based on privacy concerns, permissions, event policies, legal obligations, or requests from authorized parents, guardians, clubs, or organizations.

The presence of a photograph on the site does not grant anyone additional rights to use that photograph beyond the license provided through an authorized purchase or written permission.

12. Customer Accounts

If FonderFlicks offers customer accounts or membership features, users are responsible for maintaining the confidentiality of account credentials.

You are responsible for activity conducted through your account unless you promptly notify FonderFlicks of suspected unauthorized access.

FonderFlicks may suspend or terminate accounts associated with:

Fraud
Chargeback abuse
Unauthorized redistribution
Security threats
Harassment
Attempts to bypass purchase restrictions
Other misuse of the service

13. Site Availability

We aim to keep FonderFlicks available and functional, but we do not guarantee uninterrupted access.

The website may occasionally be unavailable due to:

Maintenance
Hosting issues
Wix platform issues
Payment-provider outages
Internet failures
Security events
Software updates
Circumstances beyond our control

We may modify, suspend, or discontinue website features at any time.

14. Errors and Corrections

Those providers may have their own terms, privacy policies, technical limitations, and service conditions.

FonderFlicks is not responsible for third-party outages, policies, or actions beyond our reasonable control.

16. Disclaimer of Warranties

The FonderFlicks website and services are provided on an “as available” basis to the extent permitted by law.

We do not guarantee that:

the website will always be error-free
every photograph will meet every customer’s subjective expectations
all galleries will remain permanently available
downloads will work indefinitely on every device or software platform

Nothing in these Terms excludes warranties or protections that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, FonderFlicks will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, inability to access the website, or use of purchased digital products.

Where liability cannot legally be excluded, FonderFlicks’ liability will be limited to the maximum extent permitted by law.

18. Unauthorized Use and Enforcement

FonderFlicks reserves the right to investigate unauthorized use of photographs or website content.

We may take reasonable steps to enforce intellectual-property rights, including requesting removal of unauthorized content, suspending accounts, restricting downloads, or pursuing other available remedies.

19. Changes to These Terms

We may update these Terms & Conditions periodically.

When we make changes, the revised Terms will be posted on this page with an updated effective date.

Your continued use of the website after revised Terms are posted constitutes acceptance of the updated Terms.

20. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute relating to these Terms or use of FonderFlicks will be handled in accordance with applicable law.
